Employment law

Employment appeals

Before challenging an employment ruling, we review what can be appealed and on which grounds. The assessment starts with the full proceedings to distinguish disagreement with the outcome from an issue that can properly be raised on appeal.

How we can help

Assessing the ruling and case file

We review the ruling, earlier submissions and evidence. We explain what information is needed to assess possible grounds of challenge and the limits of the remedy that may apply, taking account of how the case was presented previously.

Suplicación before the High Court of Justice

We assess a recurso de suplicación before the Social Chamber of the relevant High Court of Justice where available. We review whether the ruling is appealable and which grounds can be supported; the remedy does not amount to repeating the trial.

Cassation and unification of case law

We assess the applicable form of cassation, including an appeal for unification of case law where relevant. The review focuses on its specific requirements and the material needed to substantiate why the matter could be brought before the Supreme Court.

Preparing a defined strategy

If an appeal is agreed, we define the scope of the written submission and professional work. We discuss the points to be advanced and the issues still requiring documentation, keeping the possible stages of the matter clearly distinguished.

Frequently asked questions

Is the employment remedy before the TSJ called an apelación?

The remedy described here is a recurso de suplicación before the TSJ’s Social Chamber. Whether the ruling allows that remedy must be checked.

Can I always go to the Supreme Court after suplicación?

No. Access depends on the requirements of the particular remedy. The viability of a cassation appeal needs a separate assessment.
