Recognition of foreign judgments

A judgment obtained outside Spain may need recognition before it can have the effects you require here. We examine the country of origin, the subject matter and your intended use before identifying the appropriate route.

How we can help

Checking the recognition route

Foreign judgments do not all follow the same procedure. We check whether a European instrument, international convention or other rule applies, and whether an exequatur procedure is needed for the specific result you seek.

Preparing foreign documents

We examine the judgment, procedural certificates and documents relevant to its legal effect. We also review translation, legalisation or apostille requirements by reference to its origin and the particular recognition route that applies.

Application and possible objections

We prepare the application and assess circumstances that may affect recognition. If you are the party against whom recognition is sought, we review the documents received and any available grounds for opposing the application.

Recognition and enforcement

We distinguish recognition of the judgment from the steps needed to enforce it. We explain the effects being sought and any additional action that may be required concerning assets, records or obligations in Spain.

Frequently asked questions

Does a US judgment apply automatically in Spain?

This should not be assumed. The judgment, subject matter and applicable recognition framework must be reviewed before relying on it or seeking enforcement in Spain.

Is recognition the same as enforcement?

No. They are separate matters. Depending on the result sought, enforcement steps may be needed after recognition.
