Debt recovery

An unpaid invoice, outstanding loan or promissory note involves more than the amount owed. We review the evidence, identify the debtor and consider which recovery route makes sense in your circumstances.

How we can help

Building the claim

We examine the underlying obligation, payment dates and sums already paid. We also review correspondence with the other party and any preliminary steps needed to prepare a properly supported and consistent claim.

Payment-order proceedings

We assess whether the debt and supporting documents are suitable for Spain’s monitorio payment-order procedure. We explain how payment, an objection or a failure to respond can affect the next stage of the case.

Claims involving payment instruments

If you hold a bill of exchange, cheque or promissory note, we review the instrument and whether the cambiario procedure is appropriate. Its formal content and the circumstances in which it was issued matter.

From judgment to recovery

Before starting proceedings, we consider the amount, evidence and practical prospects of recovery together. If a judgment later needs to be enforced, that work is assessed and agreed under a separate scope.

Frequently asked questions

Does a favourable judgment guarantee payment?

No. Recovery also depends on voluntary payment and the existence of assets or income against which lawful enforcement can take place.

What if someone claims a debt I dispute?
