Working online is only the beginning of a digital nomad enquiry. To assess Spain’s international teleworking route, an adviser needs to understand the legal relationship behind the work: are you employed by a business or providing professional services independently?

The distinction matters

Under the international teleworking provisions, employed activity must be for businesses outside Spain. Professional activity can include work for a business in Spain within the statutory limit of 20% of total professional activity. That allowance should not be applied to employees. Law 14/2013, Article 74 bis.

The law also requires evidence concerning the business’s activity, the existing work relationship, remote working and qualifications or experience. A job title or a statement that you can use a laptop does not establish those conditions. Article 74 ter and the general requirements.

If you are an employee

Prepare your contract, start date and a description of your duties. Explain whether the employer has agreed that you may work from Spain. If you must visit clients, supervise a site or travel frequently, include those facts rather than describing the role as entirely remote.

Social security and the employer’s potential obligations also need attention. Ask what the proposed advice covers and whether additional employer-side work is required. A health insurance policy should not be treated as a substitute for that review.

If you are an independent professional

Build a table of clients, locations, contract dates, services and supporting documents. Separate actual activity from hoped-for future revenue. Where you have Spanish clients, make them visible so the relevant limit can be assessed.

Use the table during a properly scoped review. You do not need to post client contracts or financial records into a public questionnaire to discover which service to request.

A residence approval does not settle your tax position

Spain has separate tax-residence rules and conditions for its special inbound-worker tax regime. An immigration permission does not automatically establish eligibility for that regime. Personal Income Tax Law, Articles 9 and 93.

For a cross-border move, it helps to agree the scope in writing: immigration application, employer coordination, Spanish tax review and any matters left to an adviser in another country. This makes fees and deliverables easier to compare.

What if the arrangement changes?

Keep evidence of new employers, clients or duties and ask whether the change affects the conditions of your permission. The date printed on a card is not a reason to ignore a material change in the activity underlying it.
