Moving to Spain from the UK: new applicants and existing residents need different advice

A new move from the UK is different from qualifying residence before 2021. Identify your position before choosing a Spanish visa or residence process.

If you read advice written for a British person who already lived in Spain before 2021, it may not answer your questions about moving now. The first step is to establish whether you are planning a new move or need help with an existing residence position.

Start with your residence history

The UK government’s Spain guidance distinguishes people who moved before 1 January 2021 and have been living there legally since then from new applicants. It explains that qualifying residents and family members have rights under the Withdrawal Agreement. Whether an individual falls within that position requires their facts to be checked. GOV.UK: residence before 1 January 2021.

If this may apply to you, gather your residence documents and a chronology of where you have lived. Mention prolonged absences or gaps rather than assuming an old registration document settles every question.

For a new move, explain what you will do in Spain

Work, study, family and retirement plans lead to different questions. If you will keep a remote role, the work arrangement needs its own review. If you or a family member also holds an EU nationality, disclose it at the beginning.

GOV.UK links to the Spanish consulates and the relevant residence guidance. Use the instructions for the route and office that apply to you. Do not copy the document list used by a friend whose residence history or family situation differs.

Separate housing plans from immigration decisions

Buying a property or finding a rental does not answer which immigration route fits your circumstances. Treat the contract, move date and residence process as related decisions, each requiring its own checks. Avoid making an irreversible commitment solely because a general article suggests a typical processing time.

Build a two-country tax chronology

Record intended travel, homes, family location and sources of income. Spain’s tax-residence rules require more than looking at the label on a residence card or counting one period of travel. Spanish Personal Income Tax Law, Article 9.

Agree who will review the UK position and who will cover Spain. Do not assume a pension, business income or investment receives the same treatment in both countries. This article does not determine tax treatment under the UK-Spain treaty.

Residence history and plans that determine your starting point

  • Whether this is a new move or a question about existing residence.
  • All nationalities held and relevant family connections.
  • Any previous Spanish residence dates and documents.
  • Your intended activity and target timing.
  • Housing or other commitments that could affect the plan.
