How we can help
Identifying the constitutional issue
We discuss what happened and review the action you believe infringed your rights. The analysis distinguishes the fundamental right said to be affected from other disagreements about the facts, evidence or interpretation of the law in the underlying case.
Examining the earlier proceedings
We organise the history of the matter and the responses received. For challenges involving administrative or judicial action, we review exhaustion of the required prior remedies and how the alleged violation was raised in the earlier proceedings.
Assessing admissibility
We assess special constitutional significance and the other admissibility requirements. Before agreeing to prepare an amparo application, we explain which aspects need to be substantiated and which documents should accompany the proposed case for the court’s consideration.
Defining the engagement
The initial review, preparation of the application and any later work need a clear scope. We discuss our assessment and proposed tasks with you so that your decision is informed by an understanding of the work involved.
Frequently asked questions
Does the Constitutional Court review any unfavourable judgment?+
No. Amparo specifically protects fundamental rights and has its own requirements; it is not another general appeal.
Does a rights violation guarantee admission?+
No. In addition to substantiating the violation, special constitutional significance and the other requirements must be addressed. The Constitutional Court decides whether to admit the application.
